29 May 2001, Argentina Dear Dr. E-Commerce, We are a group of people who want to sell jewelry on the internet and we are planning to target the European market. But since these transactions will be of the B2C kind, we are a little bit concerned about the European Consumer Law. So far, we have this two questions: 1. If we chose a jurisdiction and applicable law in the contract, will it be respected if the Consumer wants to sue? 2. Could the Consumer sue us in an European Court? Thank You Very Much Sonia
Dear Sonia: Assuming your business is based in Argentina, European Internal Market laws are not applicable. Private international law is. As a result, if you indicate the applicable law and jurisdiction in your contract, then you cannot be sued in a European Court.
